中文摘要: 本文從臺南平埔族群爭取原住民族身分認定之過程為始,探究地方政府、中央主管機關與法院如何透過法規範肯定或否定尚未獲得原住民身分認定之族群,由各自之法律訴求與法院判決意見可知,戶籍對於原住民身分認定具有關鍵性地位,而平埔族群強調應與其他原住民族受民族平等之保護,國家應給予積極扶助。然而,對於原住民身分認定與接受積極扶助二事是否皆為中央政府專屬之權限,本文認為目前以中央政府設定戶籍標準,作為國家與人民公法權力關係身分認定之標準實有疑義,各地方政府應有依據原住民族血源、自願、文化與傳統習俗設定身分認定標準之自治權,且得自行發展地方原住民族扶助政策。

英文摘要: This article begins with discussing the fight for recognition of the identity of the Pingpu tribe in Tainan, and explores how the local government, the central authority, and the courts have used legal regulations to confirm or deny their status as a tribe, which has yet to be recognized by the state. While it is clear that the household registration plays a key role in recognizing one as an aboriginal in Taiwan, the Pingpu tribe has stressed the importance of receiving protection equal to that of other aboriginal groups, and argues that the nation should provide them with the same affirmative action. However, the question remains whether the authority to identify one as an aboriginal and to take affirmative action solely belongs to the central government. This article contends that the household registration of nationals by the central government may not be a good way for recognizing aboriginals. Instead, every local government should be allowed to set its own recognition standard, and develop its proper policies for the aboriginal communities at the local level.
