中文摘要: 包括台灣、德國在內很多國家的法制或通說都把罷工視為是工會所獨占的權利,但是從德國同盟自由概念發展的歷史過程來看,同盟自由原來的概念是指複數主體的勞動者「約定」罷工與杯葛之自由。也就是說,同盟是為了罷工而形成之一時性的結合。但是禁止工會的法制解放之後,在集體主義勞動法的思想下,為了維持國民經濟秩序、罷工秩序等目的,工會被視為是罷工秩序形成的主角,藉以排除不符合此目的之非工會所為的罷工。於是,此一工會罷工權獨占論成為德國集體主義爭議法理論的一個重要歸結。本文認為爭議行為在概念上如果不能和工會處於互相獨立的狀態的話,在現代之勞資關係中,特別是全球化所帶來之勞動法限制鬆綁的趨勢下,很難發揮勞資對等協商的功能。因此,此時應該是脫離集體主義爭議權論的束縛,展開新的爭議權理論的時刻。換言之,反省過度之集體主義的理論的傾向,以及如何從爭議權之自由權性格出發,以尊重個人自由為優先之立場來展開同盟自由和爭議權之理論是今後勞動法研究的一大課題。

英文摘要: From legislations and commonly-held legal theories, the strike was regarded as a right monopolized by the trade union in many countries including Taiwan and Germany. However, reviewing from historical development of the freedom of coalition in Germany, the original concept means a freedom that plural laborer to agree on strike or boycott. That is to say, the coalition was a combination for the moment that was formed in order to go on strike. But after the liberation of trade union, based on the thought of the collective labor law, the trade union was considered to be the protagonist who formed the order of the strike for the purposes of national economic and strike order, as well as excluded some strikes that were not following with those purposes. Therefore, the monopolized theory of “the right to strike” developed and became one of the important results under the theory of collectivism labor law in Germany. This article is considering that if the labor dispute behavior could not stay at the mutual independent position with the trade union on the concept, it would become very difficult to carry out the function of collective bargaining in the modern relationship between labor and capital, especially under the trend of globalization and deregulation. In other words, it should be broken away from the theory of collectivism about the right to strike, and launch a new theory of labor dispute right at this moment.
