中文摘要: 物權特定主義之前提下,一物之上雖僅存有一所有權,而不可存在數人享有數個所有權之情形,對於交易之明確固然有所幫助,但數人於一物上共同享有一所有權,並無違反關於一物一權主義之概念,且亦符合現實之需求,而不容忽視。關於共有之型態,現行法有分別共有、公同共有及準共有之規定,此些規定,於民法物權編修正後,在內容及效力上已有相當之變更,而有必要依據新法之規定,對於共有之整體關係加以分析,此為本文之目的。

英文摘要: Under the principle of “ object’s attribute of specific,” one article only has one ownership. However, there is no violation of the “ one article one ownership ”principle and conform with reality if several persons co-own one specific one property. This article will analyze the whole legal framework of the co-ownership,including the discussion on existing types of co-ownership, including ownership in common, joint ownership and quasi-ownership as well as their context and effect adjustment in accordance with the new “ Rights in Rem Part of the Civil Code.”
