中文摘要: 不動產買賣之價金相當高,多數民眾終其一生僅有少數買賣經驗。又不動產買賣涉及法令相當多,相關資訊非一般民眾可以掌握。多數資訊由建築開發業、代銷業者或是仲介業者所掌握,而產生資訊不對稱現象。公平交易委員會處分案件與產業發展具有緊密關係,就不動產交易行為違法案件進行研究,對於掌握不動產產業發展趨勢,導正產業發展具有重要意義。
本文以公平交易委員會處分書為主要討論對象,就不動產廠商受到處分之公司特色、違法態樣、處分時間、資訊揭露時點與地點、未揭露事項、罰鍰等,進行整體性實證研究。本文收集民國 90 年 1 月 1 日至 103 年 3 月 31 日共計 13 年 3 個月的處分案作為統計分析之範圍。與不動產交易有關之處分案計有 223 件,受處分家數共 253 家。
本文進一步就不動產交易處分案進行統計與分析,分別觀察案件類型、受處分廠商、受處分區位等,並分析建築開發業、代銷業者或是仲介業者違反之法條與類型、違反類型與應揭露到受處罰時間之差異性。就公平交易委員會之處分部分,本文分析了不動產交易違反公平交易法案件與罰鍰之關係,並從罰鍰金額、受處罰之廠商與其受罰額度、違反類型與其受罰額度探討不動產相關業者之處罰情形,最後提出結論與建議。

英文摘要: As the prices of real estate are so high, most people have probably only had a few trading experiences. Real estate transactions involve many laws and regulations, and many people cannot fully understand the transaction information. Construction companies and real estate brokers know muchabout real estate transactions, so there is the possibility of information asymmetry. What is this asymmetric information that occurs in actual real estate transactions? This is worth studying.
This article focuses on Fair Trade Commission Administrative Decisions, and discusses the characteristics of companies, the types of punishment, the disposition time, the timing and location of disclosure, nondisclosure matters, and fines, etc. We collect data on the Fair Trade Commission’scases from January 1, 2001 to March 31, 2014, over a period covering 13 years and 3months. There are 223 cases involving punishment related to real estate transactions, and 253 cases where companies and firms are punished.
This article further analyzes the real estate transaction punishment cases, and observes the types of cases, the punished companies, and the punished locations, etc. It also examines construction companies or brokerage firms that violate the ordinances, as well as the types of violation, and the time duration. In addition, we analyze the fines imposed in those cases, and discuss the amounts ofthe fines, the firms and the amount of punishment, and the relationship between the type of violation and the amount of punishment. Finally, we presentour conclusions and recommendations.
