中文摘要: 2009 年 3 月間,前行政院新聞局駐外秘書郭冠英先生因多次於網路發表爭議性文章,同年 9 月遭到公務員懲戒委員會議決:「撤職並停止任用 3 年」,停止任用期限屆滿後,郭氏復於 2014 年 3 月再任臺灣省政府外事秘書,4 月份隨即申請退休並申領年金。此一事件,在社會上引發極大的爭議,同時也激起本文撰寫的動機及興趣。本文的研究主題將聚焦於:對於不忠誠之公務員的行為,例如:公務員發表偏激言論,破壞自由民主基本秩序時,有關機關有無必要在憲法或法律下明確地劃出一道紅線?對於越線者積極主動出擊,展現出戰鬥者的決心與風範,將之逐出公部門?或者採取其他較為和緩的懲處手段,而其分寸尺度當如何拿捏?首先,配合研究課題概述源自德國的戰鬥性民主概念,以從事後續相關探討。其次,將戰鬥性民主之對象及標的限縮於公務員及其忠誠義務;並藉由剖析德國與我國相關制度,包括德國公務員忠誠案相關議決及判決,以及檢視公務員懲戒委員會 98 年度鑑字第 11520 號議決(郭冠英事件),以釐清公務員忠誠之對象、範圍及界線。最後,提出檢討建議與結論,希藉此次拋磚引玉,能開展學術上有關議題更為深入的探討。

英文摘要: In September of 2009, Mr.Guo Guan Ying, the former overseas secretary of Government Information Office in Taiwan, was punished by Public Functionary Disciplinary Sanction Commission (PFDSC) for leaving his post and refraining from being a civil servant within 3 years for his misbehaviors of posting inadequate speeches and articles on the internet 6 months ago. While he got reinstated as another overseas secretary for the Taiwan Provincial Government after the expiration of the aforesaid term in March of 2014, and later he got retired and applied for his pension, which caused great controversy in our society. Intrigued by this event, this article will commence a research focusing on whether the government can set a border line to block and to expel some dishonest behaviors by civil servants, such as making biased speeches impairing the basic democratic discipline under the approval of the Constitution or our legal system. Or can the government just make more alleviated punishment on such disorderly conducts? What will be the standard rules for the government to set? This article will first introduce the concept of Defensive Democracy originated from Germany and set the restricted scope of those who are public servants and their duty of loyalty under this philosophy, as to analyze relevant legal systems between German and ours, including some judgments and resolutions about this topic, such as No. 11520 resolution established by PFDSC on the case of Mr. Guo Guan Ying to clarify what is the scope and boundaries that the public servants should obey. And finally, we hope some suggestion from this article will initiate further more academic discussion.
