中文摘要: 由於社會的快速發展與科技的不斷進步,新的商業模式日益增加,因此擴大了商品商業化的範疇。為了刺激消費,商業化的物件不僅包含自然人,也包含法人在內,所以法人的人格利益商業利用的情形普遍存在於目前社會之中。例如以法人的名稱冠名贊助公益活動,以提高社會對該企業的好感度,或者將法人的商號印在產品包裝之上,以增加購買率,甚至是在廣告宣傳中加入能夠標表該企業的建築物形象或者標誌,使消費者將商品與該企業產生連結,進而刺激銷售業績等。但是到目前為止,中國大陸關於法人的人格利益商業利用的情形討論遠不及於自然人,縱使民法人格權編修正草案已經注意到人格權商業利用的行為,並明文加以規範,但是民法終究是以自然人為規範重心,相較於自然人,法人的部分規範顯得薄弱,而無法確實解決法人的人格利益商業利用的相關問題。
本文將以法人的人格利益商業利用的行為為討論重點,以法人的人格利益的類型為區分標準,分別探討每一項法人的人格利益商業利用的態樣與方式,並分析於目前盛行的商業行為中,人格利益商業利用的可行性。

英文摘要: The scope of commercialization of commodities is expanding due to the rapid development of society and the advancement of technology which lead to new business models are continuous increasing. In order to stimulate consumption, commercialization targets not only natural persons but also artificial persons. Therefore, the commercial exploitation of personal rights of juristic person for the purpose of profit making is widespread in the current society. For example, sponsoring a charity event under the name of juristic person to improve the societys goodwill towards the company, or printing the corporate name of the juristic person on the product packaging to increase the purchase rate, and even including the company logo or image of company building in the advertising campaign which helps consumers to link the products to the company and stimulate sales. However, the discussion on the commercial exploitation of personal rights of juristic person for the purpose of profit making in mainland China is far less than juristic person so far. Even though the draft amendment to the civil rights personal right has already noticed the commercial use of personal rights and stipulated it, the civil law still focus on natural person eventually. The norms of juristic person are weak compared with natural person, and it is hard to solve the problems related to the commercial exploitation of personal rights of juristic person for the purpose of profit making.
This paper used the types as the standard, and discuss each type and method of commercial exploitation of personal rights. And, analyze the feasibility of commercial exploitation of personal rights in the current commercial behavior.
